1. Lease Agreement

A binding rental contract between us comes about when we accept your booking by telephone, in writing or via the Internet and send you a booking confirmation, or after payment has been made. Of course, this also happens if you book in a portal where we are represented. We (as the landlord) agree to make the holiday home available to you (the tenant) for the period specified in the booking confirmation. The amount of the fee for the rental is confirmed with the booking confirmation and is to be paid to the landlord at the beginning of the rental period. With the booking, the tenant agrees to the general terms and conditions and the house rules of the landlord.

2. Arrival and departure

We are really looking forward to your arrival and getting to know you. Arrival (Check-In) is generally possible between 4 p.m. and 6 p.m. Departure (Check-Out) must be made until 11 a.m. We are happy to arrange other arrival and departure times individually. However, they require our written confirmation. If you do not show up by 10 p.m. on the day of arrival (unless you call because you are stuck in traffic, the plane is late, etc.), the contract is considered terminated after a period of 48 hours without notification to us as the landlord. We as the landlord can then freely dispose of the property. We reserve the right to charge for a delayed departure of more than 60 minutes.

In the event of early departure, there is no entitlement to a refund of the rental price.

3rd stay:

The use of the holiday apartment is reserved for the guests notified to the landlord when booking. If the holiday apartment is used by more people than agreed, a separate fee must be paid for them according to the price list. Subletting and letting of the apartment to third parties is not permitted.

In the event of violations of the terms and conditions or the house rules, the landlord is entitled to terminate the tenancy immediately and without notice. There is no legal entitlement to repayment of the rent or compensation.

Before you arrive, you will receive a door code from us that is valid for your entire stay.

3. Dogs

You are welcome to bring your four-legged friend to us. We charge an additional cleaning fee per dog of €20/night. Since we are dog owners ourselves, it is important to us to enable you to spend your holiday with your furry friend. BUT: No dogs on sofas or beds! Here we think of other holiday guests who may have an animal hair allergy, even if we vacuum and clean everything professionally after your stay. Please also make sure your paws and fur are clean when you come into the apartment after a walk. In the event of non-compliance, we reserve the right to terminate the rental agreement without notice and to have a professional cleaning carried out at the expense of the tenant.

ALL OTHER ANIMALS are ONLY allowed on request.

4. Payment:

The rental agreement becomes valid upon receipt of the payment on our account. If a deposit is made for the booking, the remaining amount is due no later than 7 days before arrival. If the payment deadlines are not met, we as the landlord can withdraw from the contract and the same fees will be due as in the case of cancellation. Failure to pay is considered withdrawal and entitles the tenant to re-rent. The rental price includes bed linen, initial set of towels, kitchen towels, sauna towels and bathrobes. Additional costs for water, energy costs, parking space, use of the sauna and waste are not charged separately. The final cleaning will be charged separately.

5. Withdrawal

You can withdraw from the contract at any time. The withdrawal must be made in writing. In the event of withdrawal, you are obliged to compensate us for the damage we have suffered:

Cancellations within the first 48 hours after booking (timestamp of the booking in the booking system) are free of charge.

For cancellations after the first 48 hours after booking, we charge 10% of the total booking amount, less the cleaning fee and any additional packages booked, up to 14 days before the day of arrival.

For cancellations within 14 days before the day of arrival, we charge 50% of the total booking price, less the cleaning fee and any additional packages booked.

If a booking is only canceled on the day of arrival, we will charge 90% of the total booking amount, less the cleaning fee and any additional packages booked.

In the event of early departure or no-show without cancellation, the full booking amount must be paid.

We are held in good faith to let our holiday apartment to someone else if a booking has not been taken up, in order to avoid losses and to keep the cancellation fees low for the guest.

We recommend travel cancellation insurance for your stay at Luxapart. The date of receipt of your cancellation message counts. Amounts already paid will be offset. You are welcome to provide a replacement person who enters into your contract under the conditions stated. Please request the okay from us in writing.

6. Renter's Obligations

We really put a lot of effort into furnishing and equipping Luxapart Eifel. Hence the following clause: The tenant undertakes to treat the rented items (holiday apartment, sauna, inventory and outdoor facilities) with care. If damage occurs to the holiday apartment and/or its inventory during the tenancy, you are obliged to report this immediately to Kürsten & Kürsten Immobilienverwaltungs GbR so that we can arrange for repairs and replacements. If you notice any defects or damage when you arrive, you must report this to us immediately and without delay, otherwise the tenant will be liable for this damage. A reasonable period of time - at least 36 hours - must be granted for the elimination of damage and defects. Claims from complaints that are not reported immediately on site are excluded. Complaints received by the landlord at the end of the stay or after leaving the holiday home are also excluded from compensation.

Parties or loud music are not allowed on the terrace, out of respect for our neighbourhood.

On the day of departure, we ask you to remove your personal belongings, dispose of household waste in the bins provided, put clean and washed dishes in the kitchen cupboards and empty the refrigerator.

Our Luxapart is a non-smoking holiday apartment. We are happy to provide an ashtray on the terrace.

7. WiFi Usage
During your stay you will have internet access via WLAN. You will receive the access information upon your arrival. We allow our tenants to share the WiFi access for the duration of their stay. If we (the landlord) become aware of the illegal use of the WLAN access (file sharing, pornography, etc.) by the tenant, we will immediately exclude the tenant from using it and inform the authorities about the misuse. We (the landlord) are not liable to the tenant for disruptions to the WLAN access. The landlord is entitled to restrict the scope of use of the tenant's WLAN access at any time. The landlord assumes no liability for any damage (malware or similar) caused by the use of the WLAN access. The tenant has to ensure the security of his data independently. If the renter makes use of paid services or similar via the WLAN, he/she assumes the costs incurred for this in full.

8. Liability

We have created our terms and conditions to the best of our knowledge. We are not liable for any influence on the rental property due to force majeure, power and/or water failures and storms. Likewise, there is no liability in the event of unforeseeable or unavoidable circumstances such as official orders, sudden construction sites or disruptions caused by natural and local events. Of course, we're happy to help with troubleshooting (as far as we can). Liability on the part of the lessor for the use of the play and sports equipment provided is excluded.

Your arrival and departure is your own responsibility and liability. We (the landlord) are not liable for personal belongings in the event of theft or fire. The tenant is fully liable for willful destruction or damage. Parking vehicles of all kinds, including parking bicycles and other items on our property, is at your own risk. Liability by the landlord is expressly excluded.

As the lessor, we reserve the right to withdraw from the rental agreement in cases of force majeure or other unforeseeable circumstances that make it impossible to fulfill the rental agreement. In this case, liability is limited to reimbursement of the rental price. In the event of justified withdrawal, the lessee is not entitled to compensation. Liability for travel and hotel costs is excluded.

9. Final Provisions

Photos and text on the website or in our flyer and on social media platforms serve as a realistic description. We cannot guarantee 100% correspondence with the rental property. We reserve the right to change our equipment (e.g. furniture, decoration, etc.).

Severability clause: Should one or more provisions of these terms and conditions be or become invalid, this does not affect the validity of the remaining conditions. The ineffective provision is to be replaced by an effective one that comes as close as possible to the economic and legal will of the contracting parties. German law applies. Place of jurisdiction and place of fulfillment is the place of residence of the landlord.
